1. Introduction

Welcome to The Forbes Clinic of Integrative Medicine ("the Clinic"). By engaging our services, you agree to comply with and be bound by the following Terms of Engagement ("Terms"). These Terms outline the mutual expectations and responsibilities between you ("the Client") and the Clinic.

2.Services

2.1 Discovery calls for prospective clients

The clinic offers both paid and free discovery calls for prospective clients to assess the suitability of our services.

New Client offer:
Payments for paid discovery calls are due upon purchase but the cost is redeemable against a subsequent Integrative Health Assessment. To redeem, please use the voucher code provided in your discovery call booking confirmation email. This voucher code is valid for one redemption against an Integrative Health Assessment and cannot be used for any other services or products. See below for booking and payment terms.

2.2 Integrative Health Assessment

The clinic offers Integrative Health Assessment with a medically trained functional medicine or Integrative Medicine Doctor. Your consultation fee includes the creation of an Integrative Medicine Health Plan provided within 7-10 days. You may purchase your appointment in full upon booking, or secure it with a non-refundable £100 deposit. See below for booking and payment terms.

2.4 Functional Testing

The clinic provides comprehensive practitioner-initiated functional testing, available to registered clients at a preferential rate following a consultation. Additionally, we offer a select range of functional tests that can be purchased directly through our website, without the need for a prior consultation.

Functional testing is facilitated by the clinic via our third-party suppliers in line with their own privacy policies and terms and conditions. By purchasing testing services, you acknowledge you have read and agree to the terms laid out in our Privacy Notice and theirs (available in our privacy notice and on the relevant product page).

Sample Collection and Returns:
You are responsible for collecting and returning your sample in line with the instructions included in your test kit. Testing services include postage to your address and return postage to the laboratory. The Forbes Clinic is not liable for issues arising from errors in collection or return.
Turnaround Times and Analysis:
Turn around times provided are estimated. The Forbes Clinic is not responsible for delays in postage, analysis, or reporting. We will endeavour to keep you informed should any delays or issues arise during analysis.
Payments, Refunds, and Complaints:
Payments are due upon purchase and are non-refundable once your order is submitted to our testing partner. Exceptions may apply at the discretion of the third-party provider if they breach their provider terms and conditions. The Forbes Clinic will manage communication with third parties for complaints and will endeavour to support you to seek a resolution in line with their terms
Purchasing via our site without prior consultation:
Results provided to clients without an initial consultation are based solely on your test data and may not reflect your full medical history or current health status. We recommend an Integrative Health Assessment for a more comprehensive and accurate approach. Practitioner recommendations are general and should not replace advice from your primary healthcare provider. Test interpretations may be provided by a practitioner who may or may not be a licensed medical doctor –all interpreting practitioners are appropriately trained and certified in Functional Medicine. Results are interpreted through a nutritional, lifestyle and Functional Medicine lens. This service does not replace consultation with your primary care physician. It is your responsibility to seek further evaluation, diagnosis, or treatment. The Forbes Clinic is not liable for any medical, financial, or other consequences resulting from the use of these services.

By purchasing testing services, you agree to these Terms and Conditions.

3. Appointments

Booking: Appointments can be scheduled through our website, via the Practice Better client portal for existing clients or by contacting the Clinic directly.
Confirmation: Upon booking, you will receive a confirmation detailing the date, time, and nature of the appointment.
Cancellations and Rescheduling: We require at least 48 hours' notice for cancellations or rescheduling. Late cancellations may incur a fee equivalent to 50% of the full appointment cost. No shows may incur a fee equivalent to 100% of the full appointment cost. Deposits, where applicable, are 100% non-refundable.

4. Fees and Payment

Consultation Fees: Fees vary depending on the service and practitioner. Current pricing is available on our Services Page.
Payment Terms: Payment terms vary across our services and will be indicated at the point of purchase via our website. Payments are either:

- Due at the point of booking
- Secured via a 100% non-refundable deposit with the remaining balance due 7 days prior to consultation
- Secured without payment with the full balance due 7 days prior to consultation
- Your details will be stored securely on our Practice Management System, Practice Better and any outstanding balance will be automatically charged to your chosen payment method 7 days prior to consultation.
Payment Methods: We accept various payment methods as indicated on our website.
Processing Payments: By proceeding with a booking you agree to the secure processing of data related to your chosen payment method.
Amending your payment details: You may Contact Us to request deletion of, or amendment to your chosen payment method at any time.
Insurance: Please note that our services may not be covered by all insurance providers. It is your responsibility to verify coverage with your insurer.

5. Client Responsibilities

Accurate Information: You agree to provide accurate and complete information regarding your health, medical history, and any other relevant details to facilitate effective care.
Compliance: Following the health plans, recommendations, and advice provided by our practitioners is essential for optimal outcomes.
Communication: Inform us promptly of any changes in your health status or concerns regarding your care.

6. Confidentiality and Data Protection

Privacy: We are committed to protecting your personal information in accordance with applicable data protection laws. Our Privacy Notice outlines how we collect, use, and safeguard your data.
Medical Records: Your medical records are confidential and will only be shared with your consent or as required by law.

7. Limitation of Liability

No Guarantees: While we strive to provide high-quality care, we cannot guarantee specific outcomes or results from our services.
Scope: Practitioners at The Forbes Clinic do not diagnose medical conditions or prescribe medications. Our care should not replace engagement with your primary care provider. Our services are not intended for emergency or urgent care. You should contact your primary care provider or emergency services in the case of an acute or emergent medical event or mental health crisis.
Liability: To the fullest extent permitted by law, the Clinic and its practitioners shall not be liable for any indirect, incidental, or consequential damages arising from your engagement with our services.

8. Complaints and Dispute Resolution

Complaints Procedure: If you have concerns or complaints about our services, please refer to our Complaint Procedure for guidance on how to proceed.
Dispute Resolution: In the event of a dispute, both parties agree to attempt resolution through informal negotiation before pursuing formal legal action.

9. Amendments to Terms

The Clinic reserves the right to amend these Terms at any time. Any changes will be communicated to you and will become effective upon your continued engagement with our services.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
